Abstract

Sex change is considered a case of psychological or medical illness that affects a person, making him unable to live according to his natural sex, as it makes him believe that he belongs to the other sex, which prompts him to undergo a sex change operation by replacing the original reproductive organs with female or male reproductive organs, depending on the person’s condition. The transgender person, so here we have several questions about the legal treatment of the transgender person from the point of view of the law, and in particular, what are the legislative developments that affected the law so that it can deal with the idea of sexual transformation, as the law did not deal with the process of sexual transformation, especially the Iraqi law, where it is viewed as a crime. Which affects public morals. As for Iranian law, we find that dealing with the sex reassignment process is somewhat more streamlined, but there is no law that deals with the subject. Rather, it is scattered texts in the Iranian Civil Code and the Family Law, where there is a series of procedures that must be taken before embarking on the sex reassignment process.
